Candidates take legal action | WAVY.com | Portsmouth

PORTSMOUTH, Va. (WAVY) - Two Portsmouth City Council candidates are taking legal action against the city regarding a ballot deadline.

Former councilwoman Elizabeth Psimas and Paul Smith filed paperwork seeking to reverse an electoral board decision that's keeping them off the ballot because of mix-up over the filing deadline.

Both candidates filed to run before June 12 because state and local officials advertised that day as the deadline. The city charter was revised last year, and it stated the deadline was one week earlier.

"At the end of the day, what keeps us as Americans, is the ability to vote for the people who deserve to lead our city, lead our communities," one of two attorneys representing the candidates Steve Heretick said. "We think that everyone should have an equal right to follow the same law and file for candidacy."

The two candidates are hoping to get on the Nov. 6 ballot by forcing the City to reverse their decision not to allow them to run.

Nintendo hinted it was improving its notoriously rudimentary online access with word of the Nintendo Network early this year, and was even more adamant at E3 about making a big push into digital video. Some have accused the company of nothing but flag-waving -- if that's true, the waving is about to turn into a full parade through a new hire. As of July 1st, Nintendo is bringing on Disney's former Interactive Media Group senior VP Duncan Orrell-Jones to take on the just-minted role of senior VP for the company's Network Business group in the US. He'll be handling the overall American digital strategy, which covers both gaming as well as content. We'll need to wait awhile before we see the results, but if it helps make sure friend codes never rise from the dead to haunt our Wii U, we're all for it.

Constellation buying rest of Crown for $1.85B

VICTOR, N.Y. (AP) ? Constellation Brands is buying the remaining 50 percent stake of Crown Imports LLC that it doesn't already own from Anheuser-Busch for $1.85 billion, giving it more U.S. control over Corona beers and other breweries.

Shares of Constellation added $1.74, or 8 percent, to $23.50 in premarket trading on Friday.

The acquisition will make Constellation the third-biggest total beverage alcohol company in the U.S., the company said Friday. Constellation has imported, marketed and sold Modelo brands in the U.S. for nearly 20 years.

Constellation is buying the stake from Anheuser-Busch InBev SA/NV, which on Friday announced that it was buying Constellation's joint venture partner on Crown, Grupo Modelo, for $20.1 billion.

Other beers owned by Crown Imports LLC include Corona Extra, Corona Light, Modelo Especial, Pacifico, Victoria and Negra Modelo. Constellation's brands include Simi, Svedka vodka and Robert Mondavi.

Constellation Brands Inc. will suspend a $1 billion share buyback program which is about $700 million shy of topping out.

The transaction gives Constellation and Crown complete, independent control of distribution, marketing and pricing for all Modelo brands in the U.S. InBev will handle supply continuity, product quality and new innovations.

Constellation, based in Victor, N.Y., says it has fully committed bridge financing in place for the deal. Permanent financing is expected to include a combination of revolver borrowings, a new term loan under the company's current senior credit facility and the issuance of senior notes.

The deal, which still needs regulatory approval, is expected to close during the first quarter of 2013. Constellation anticipates that the transaction will significantly add to its future earnings per share and free cash flow.

Calif. ? In opting to become the nation?s largest city to seek federal bankruptcy protection, this river port of 290,000 took a rare financial step of last resort after struggling with the economic downturn, soaring pension costs and contractual obligations.

Thirteen cities, counties and other government entities filed for bankruptcy protection last year ? the highest annual level in nearly two decades. Stockton was the seventh U.S. municipality to file this year and the first California city since Vallejo, which sought protection in 2008, according to James Spiotto, a Chicago bankruptcy attorney who tracks municipal bankruptcies.

?Filing bankruptcy is time-consuming, expensive and complicated,? said Spiotto, noting that Vallejo spent millions of dollars alone on attorneys and other bankruptcy professionals. ?And you never get the results you desire.?

That?s why experts are divided on whether other financially struggling cities, towns and other government entities will follow Stockton to bankruptcy court. Spiotto said it will be hard and expensive for Stockton to obtain financing.

Others say bankruptcy comes with non-monetary costs, too.

?Being in bankruptcy is decimating to your staff and morale,? said Deborah Lauchner, Vallejo?s finance director. ?There?s so much uncertainty....We?ve been taken apart and ripped by the seams and everybody examined us.?

Since Congress added Chapter 9 to the bankruptcy code in 1937 to allow municipalities to seek protection, some 640 government entities have filed. Last year?s 13 filings almost doubled the six filed in 2010. That was the most since an equal number were filed in 1994.

By comparison, roughly 1.5 million Americans file for personal bankruptcy a year while some 50,000 companies file for business bankruptcy.

?Bankruptcy is a huge drain on municipalities, because they have limited ways to create more revenue,? said Los Angeles bankruptcy lawyer, Karol Denniston.

Stockton City Manager Bob Deis said officials were left with little choice but to recommend bankruptcy after failing to hammer out finance agreements with creditors to address the city?s $26 million budget shortfall.

?Unfortunately we have no comprehensive set of agreements with our creditors that would eliminate the deficit and avoid insolvency,? Deis said at the City Council meeting Tuesday night. He said, however, that the city was still negotiating with some creditors and could reach deals with as many as one-third of them.

?We think Chapter 9 protection is the only choice left,? Deis said. ?If we get any agreements, those will be honored in Chapter 9.?

The City Council on Tuesday voted 6-1 to adopt a special bankruptcy budget to address Stockton?s $26 million shortfall if the city files for bankruptcy, as expected, by Friday.

The city has been hit hard by high crime and the collapse of the housing market in the past three years. It?s also dealt with $90 million in deficits through a series of drastic cuts.

The new budget did not call for additional service cuts beyond those that earlier slashed the police force by one-fourth, the fire department by one-third and 40 percent of other city employees, along with wages and medical benefits.v

The budget approved Tuesday night would suspend payments for debts and legal claims; reduce payments for retiree medical benefits; further cut some pay and benefits; and increase revenue through code enforcement and parking citations.

In standing room only chambers, former city employees told council members about their life-threatening medical conditions and said benefit cuts meant they would effectively lose their health insurance.

?For me, bankruptcy might as well be a life sentence,? said Gary Jones, a retiree who used to be a police officer in Stockton and said he was diagnosed with a brain tumor.

Other residents complained about plummeting property values, and recurring break-ins and robberies.

?The average citizen will not put up with this. Their home prices have plummeted, they have no jobs, a lot of people are getting fed up so that they have to resort to crime.? said Gregory Pitsch, a 22-year-old unemployed resident who made an unsuccessful run for mayor. ?I?m asking you to make the right decision, not destroy the property values in this city, which bankruptcy will do.?

But city officials said this Central Valley city in California?s agricultural heartland has run out of options. In recent years, thousands of new homes mushroomed in Stockton, part of a suburban housing boom that attracted buyers from the San Francisco Bay Area and beyond. When the economy crashed and the construction bubble burst, Stockton was battered by foreclosures and lost income from property taxes and other fees.

Under bankruptcy protection, officials would retain power over day-to-day city operations and staffing, but a judge would take over all decisions concerning the city?s debts, said Robert Benedetti, professor of political science at the University of the Pacific in Stockton.

The judge would decide which creditors should be paid, how much and in what order. He would make allowances for expenditures needed by the city to function, and it would be up to city officials to decide how to spend that money.

?One of reasons a city might want to go the bankruptcy route is that they don?t want a situation where they have to pay out debts and have to close the police or fire department,? Benedetti said. ?Filing for Chapter 9 means you?re asking the court to protect you against lawsuits from people who hold your debt.

?Bankruptcy won?t take away Stockton?s underlying financial problems, one of which is the economy, the high unemployment rate and the high foreclosure rate,? he said. ?It will take years for them to come out of this.??

If Stockton files for bankruptcy, it would be the largest city by population to do so, according to Spiotto, the Chicago bankruptcy lawyer who tracks filings. He said Bridgeport, Conn., is currently the largest city to file for bankruptcy, which it did in 1991.

Jefferson County in Alabama is the largest local government bankruptcy filing to date in terms of the size of its debt. It occurred in November 2011 and was followed by Orange County, Calif., in 1994.

Stockton was the first city to test a new state mediation law, Assembly Bill 506, which is less than six months old.

Under the law, municipalities considering bankruptcy must first negotiate behind closed doors with creditors for up to three months, with the goal of settling debts without filing for Chapter 9 protection.

Bankruptcy lawyer Denniston, who helped draft the bill, said legislators in other states are interested in how the mediation process could be used elsewhere.

?Nationwide, we?re faced with a ton of municipal distress,? Denniston said, noting dire economic conditions, massive foreclosures and future pension obligations. ?It?s the perfect storm.?

NASA's been solicited ideas for exploring Mars, but Dutch entrepreneur Bas Lansdorp is already planning a different kind of trip than is likely to come from the U.S. government. Lansdorp's Mars One project has the goal of putting humans on Mars in 2022, with a twist that might dampen many people's hopes to be a Mars-exploring astronaut: the trip Lansdorp plans is one-way only. That means dramatically less fuel on board, because unlike typical Mars voyage plans, there would be no need (or ability) to carry the mechanism or the energy storage to return to Earth. If you (and three close companions) are willing to go be the first people to die on Mars, you'll also need to give up more than a pinch of privacy, because the Mars One plan to obtain the necessary funding is straightforward: create a media spectacle, and monetize it through advertising. If the roof is slate, then most often people tend to patch any damage up with tar. That is the wrong thing to do as all it does is conceal the damage; instead it is best to replace the damaged shingles. The way to figure out which shingles need replacement you need to tap all of them and listen. The ones that are good will return a sharp sound while the ones that need replacement will sound heavy.

If you are in a place that is notorious for severe winters, then it is important to guard against ice formation on your roof. Before winter sets in you should clean the roof of any debris that has collected on the shingles. If debris is not removed, it can allow ice formations, and ice can crack the tiles. So make sure you clean the roof before the start of winter and that there is no debris on the rooftop.

Below the shingles is the flashing. When a leak starts to appear make sure you check the flashing under the shingles as well. It could just be that the flashing is worn out or damaged. The sheathing under the shingles also needs to be checked for damage if you are dealing with leaks.

A roof is built to last anywhere between 75 and 100 years. Proper roof care will ensure it outlasts you. Just a little goes a long way, so make sure you create a roof inspection schedule and follow it.

(AP) ? North Korea dispatched soldiers to pour buckets of water on parched fields and South Korean officials scrambled to save a rare mollusk threatened by the heat as the worst dry spell in a century gripped the Korean Peninsula.

Parts of both countries are experiencing the most severe drought since record-keeping began nearly 105 years ago, meteorological officials in Pyongyang and Seoul said Tuesday.

The protracted drought is heightening worries about North Korea's ability to feed its people. Two-thirds of North Korea's 24 million people faced chronic food shortages, the United Nations said earlier this month while asking donors for $198 million in humanitarian aid for the country.

Even in South Phyongan and North and South Hwanghae provinces, which are traditionally North Korea's "breadbasket," thousands of hectares (acres) of crops are withering away despite good irrigation systems, local officials said.

Reservoirs are drying up, creating irrigation problems for farmers, said Ri Sun Pom, chairman of the Rural Economy Committee of Hwangju County.

A group of female soldiers with yellow towels tied around their heads fanned out across a farm in Kohyon-ri, Hwangju county, North Hwanghae province, with buckets to help water the fields. An ox pulled a cart loaded with a barrel of water while fire engines and oil tankers were mobilized to help transport water.

The North Korean villages of Kohyon-ri and Ryongchon-ri were among several areas that journalists from The Associated Press visited in recent days.

Pak Tok Gwan, management board chairman of the Ryongchon Cooperative Farm in North Korea, said late last week that the farm could lose half its corn without early rain.

Mountainous North Korea, where less than 20 percent of the land is arable, has relied on outside food aid to help make up for a chronic shortage since natural disasters and outmoded agricultural practices led to a famine in the 1990s. North Korean farmers still face shortages of fuel, tractors, quality seeds and fertilizer, the U.N. said in a report earlier this month. Many irrigation systems rely on electrically powered pumping stations in a country with unstable power supplies, the report noted.

On Tuesday, North Korean state media reported record-high temperatures in Pyongyang and other cities in the southwest.

South Korean officials also reported the worst drought in more than a century in some areas after nearly two months without significant rainfall, raising worries about damage to crops and a dangerous drop in water levels in the nation's reservoirs.

"The worst drought in 104 years is causing damage to our agricultural and livestock industries, resulting in price hikes in some farm products," Finance Minister Bahk Jae-wan told a crisis management meeting Tuesday.

Nearly 28,000 South Koreans, including soldiers and local residents, have been mobilized to help water rice paddies and farm fields and more than 13,000 water pumps have been provided to drought-stricken areas, the Ministry for Food, Agriculture, Forestry and Fisheries said.

South Korean Prime Minister Kim Hwang-sik picked up a hose to water a field during a visit Tuesday to Hwaseong, south of Seoul. Beneath a blazing sun, dead fish could be seen on the nearly dried-out bed of a reservoir in Bongdam village in Hwaseong.

Rain is forecast for South Korea this weekend, the Korea Meteorological Administration said in Seoul. The agency could not confirm the dry spell reported in the North, but dispatches sent by North Korea to an international weather center indicated little rain over the past several weeks there as well, spokesman Jang Hyun-sik said.

The drought also has led to deaths of a highly endangered species in a reservoir in the southern city of Nonsan in South Korea. Hundreds of cockscomb pearl mussels have perished since June 14 when the reservoir's water levels drastically dropped, local official Lee Soo-jung said. Officials have been trying to move the cockscomb pearl mussels to water, she said.

Officials blamed high atmospheric pressure over the Korean Peninsula for the drought.

Far from the dutiful progeny of "Dance Moms," these are individuals of uncommon skill, self-knowledge, maturity and drive. They're the real deal. And so is First Position.

All of the dollars and expertise that produced this summer's blockbusters could never produce a spectacle as wondrous as 11-year-old Aran Bell dancing his heart out.

Kargman ... brings a welcome empathy to this programmatic film that follows six hopefuls as they compete in something called the Youth America Grand Prix, which we're told is the most comprehensive ballet competition in the world.

The children are almost unearthly in their agility and elegance -- until they remove their shoes, and reveal their all-too-human abrasions and injuries.

It's a wealth of material at odds with a scant running time and shallow focus.

When it's over, you won't remember so much about who won and who lost. Instead, what remains is the expression on a young dancer's face, reflected in a mirror: showing the joy of being in love with what you do.

What we experience is the overwhelming thrill of the competition and the true agony of defeat.

It could very well compete for Best Documentary at next year's Academy Awards.

For someone (like me) who has never been to a ballet, the talent of these teens and tweens is a revelation.

It's 'Spartacus' en pointe.

Inspiring documentary about hardworking young dancers.

Almost loses its sense of good taste entirely in the final act, straining to build suspense and shape heroes. The bias hangs a little ugly in an otherwise passable, somewhat enlightening effort.

The cookie cutter format Kargman uses in presenting her subjects may be unoriginal but a safe way to introduce the filmmaker to her new audience.

Child ballet dancer and former journalist Bess Kargman brings a dancer's passion and insight to her directorial debut, illuminating the addictive magic and fierce demands of a ballet dancer's life.

Really, all of the dancers' evident passion for their art is, well, spellbinding.

Confessions of a Stay-At-Home Mom: Baby Shower Tips and Ideas



Today we celebrated my middle sister's Baby Shower. ?Lissa is due to have her first baby, a boy, in late August. ?I finally get to be an Aunt! While I've had baby showers thrown for me, I've yet to actually throw one myself. Since my sister does a good job of going all out for other people's celebrations, I wanted to make sure she had a fantastic shower. ?I did a good bit of research on Pinterest to gain ideas, and eventually started piecing the party together with my youngest sister, Jess, and my Mom.?


We love to throw parties, but we are not very good at the "theme" aspect. I have some great friends who really pull together a great thematic party. I am just not one of those people. ?Still, I feel we celebrated Melissa well. ?


Below I've put together some Baby Shower tips and ideas. ?If you are attending a shower and need a gift idea, or you are throwing a shower and need a place to start on decorations, food or games, I've got you covered.

Decorations

There are TONS of theme ideas out there on Pinterest?and other blogs, so if you can go with a theme, do it! ?We kept it simple, opting for blue accents, since my sister is having a boy. ?I found these cute ceiling pom-poms at a local party store. ?
I've seen tutorials on how to make them, but was too intimidated (and time crunched). Now that I've worked with them, I think they'd be simple enough to DIY.


We also showcased the baby's name. If your mama-to-be has shared the name, make it a highlight of the party!

If you have a gift table or food table, glam it up by making it into a Lighted Display Table: Drape a white table cloth over the table (which should be near an electrical outlet). ?Plug in 1-2 strands of christmas lights, and lay them on top of the table. ?Place a sheer overlay fabric (just go to your local fabric store and buy a yard of pretty sheer fabric) over the lights. Viola! ?Super cute and classy! ?Below you can see what would become our Dessert table with a sheer blue overlay. This would also look fabulous during the holidays with a sheer red overlay!

Gifts

You cannot go wrong with buying a gift off of a Baby Registry. If they registered for it, then they obviously want (and need!) it. ?After having 2 babies of my own, I found that you often don't know what you need until you need it. And can I say it's usually late at night when going to the store is inconvenient?? So I've started giving this resourceful gift to all mamas-to-be: The You Didn't Know You Needed It Pail

I buy a very inexpensive diaper pail (because, let's face it, you can always use an extra!). ?I then fill the diaper pail with all of the essentials that become part of a mom's daily life: head-to-toe baby wash, medicines [infants tylenol and ibuprofen, gas drops, gripe water, etc], diaper rash cream, saline drops, nail clippers, pacifiers, a pacifier clip, a teething necklace, wipes, newborn toys, bibs, etc etc.

Games

Games keep the party moving, so having 2 or 3 to space out over the course of the party is key. We chose to do 3: one game that people could do as they walked in, one they could do mid-way through, and one guests could do during the gift opening. And who doesn't like to win a prize?! Once again, we kept it simple but fun.

This one may seem "cruel," but if the mama-to-be is good-natured, it can be fun. Have 1-2 skeins of yarn. Guests arrive and cut a piece of yarn they think is the correct measurement of the mama-to-be's waistline. Before gifts are opened, a correct yarn measurement is taken, and the person whose piece of yarn is the closest wins!

Some people thought this was gross, but I think it's awesome. I chose 6 different chocolate candy bars (Snickers, Milky Way, Kit-Kat, Hershey's, Reese's Peanut Butter Cup and Almond Joy). I melted each in a bowl, one by one. So once I melted the first chocolate bar, I spooned it into Diaper #1 (which I labeled). I melted the next chocolate bar and spooned it into Diaper #2, and so on. ?Guests had to write down their guesses as to what kind of candy bar each diaper held. ?They could sniff, taste, etc. The participant with the most correct wins!
This is a classic shower game, both at bridal showers and baby showers. ?Guests are given a blank Bingo Board, and asked to fill out the boxes with items they think the mama-to-be (or bride-to-be) will receive. ?If she receives a gift they've guessed, they mark off the box. Food

What is a party without FOOD? ?One thing my family knows how to do is feed people! ?We had a great spread of hot roast beef for sandwiches, various side dishes and scrumptious appetizers. One of my contributions was my tasty Pecan Chicken Salad. ?I re-created this salad after repeatedly enjoying a similar salad from a local cafe. At the cafe, it is served on a bed of lettuce accompanied with a fruit salad and a side of Poppy Seed Dressing. ?I often make it and spoon it on a roll, top it with a pickle, lettuce and tomato for ?a tasty lunch. ?This recipe is truly a crowd pleaser! ?The chicken salad looks more like pate, so you may want to label it in case people confuse it for tuna. ?If you are making tea sandwiches ahead of time, drizzle with Poppy Seed Dressing and top with lettuce and tomato. Top Tips For Anyone Thinking About Bankruptcy

Although it may be difficult to get financing after filing for bankruptcy, it will not be impossible by any means. Although there may be some truth to this, it should still be better than your credit situation was before you filed for bankruptcy. Going forward, make sure to pay all bills on time for a positive credit history.

Act when the time is right. Timing is everything, especially in personal bankruptcy filings. Sometimes, it is good to file immediately, but sometimes it is smarter to wait until you have passed through the worst of things. Talk with a bankruptcy attorney to find out the ideal timing for filing based on your particular situation.

Remember that your Chapter 7 filing may affect other people in your life as well. When filing Chapter 7, you are not legally responsible for the debts in your name. However, the creditors could come after your co-signer and demand full payment for the debt.

Remember to have fun with your life when you?re done with the filing process initially. It can be several months between the initial filing and the final discharge of debts. It is essential to cope with this stress well, to prevent becoming depressed. You must realize that things will get better over time.

Filing for bankruptcy will probably not help you in the event of exorbitant taxes. Some people pay off tax debt using a credit card, then declare bankruptcy soon afterward. This is done on the mistaken belief that since the amount owing is now owed to a credit card, they will get away with not paying taxes. Remember that even if you use a credit card to pay for your taxes while you file for bankruptcy, you are still going to owe the amount due.

Make sure that you are as honest as you can be when you file for bankruptcy. If you fail to disclose pertinent information in your filing, your case might be dismissed right away. Disclose any income or assets that are crucial to the proceedings. Doing so helps you demonstrate good faith and facilitates an appropriate outcome.

Consider Chapter 13 bankruptcy for your filing. In most states, Chapter 13 bankruptcy law stipulates that you must have under $250,000 of unsecured debt and a steady income. That kind of bankruptcy allows you to hold on to your personal things and real estate while repaying your debts with a plan to consolidate your debt. This plan normally lasts from three to five years, in which you?ll be discharged from unsecured debt. Consider that if you even miss one payment, your case will not be considered by the court.

Two to three months following your bankruptcy hearing, get a copy of your credit score from the major reporting agencies. Make sure that the report accurately represents your discharged debts and closed credit accounts. Contact the credit reporting agencies if there is a discrepancy in order to rebuild your credit.

Be certain you understand all you can about bankruptcy by researching reputable sites that offer good information. Many sites, including the U.S. Department of Justice and American Bankruptcy Institute are two such places to look. The more information you have, the more confident you can be about any decision you make and you will know that you are doing the best thing possible for your situation.

Know the rules of personal bankruptcy prior to petitioning. There are many laws which govern bankruptcy; therefore, to protect your bankruptcy case, know the rules. Not only could your case be dismissed, but it may also affect your ability to refile. Thoroughly research bankruptcy before you make the decision to file. This will make things a lot more simple in the long term.

Proper planning is the best place to start. It?s best to take as much time as possible. It is important that you are moving in the right direction away from bankruptcy filing. At this point, you can begin making plans and preparing yourself for your future.

PM indicates cabinet reshuffle, returns from Brazil, Mexico

Indian Prime Minister Manmohan Singh returned in New Delhi on Saturday after a visit to Brazil and Mexico.


Manmohan Singh had attended the Earth Summit in Rio de Janeiro prior to which he attended the G20 Summit at Los Cabos in Mexico.

Prime Minister Manmohan Singh has indicated a cabinet reshuffle but declined any comment on its timing, or who will replace Pranab Mukherjee as finance minister.

"I think that's a legitimate expectation," he told the accompanying media delegation to the G20 and Rio+20 summits to Mexico and Brazil, on his way back to New Delhi Saturday when asked he wished to reshuffle his cabinet.

"You will get to know about it when it takes place," he added, when also queried if more parties were set to formally join the United Progressive Alliance in the near future.

The prime minister said he has been thinking about who will take over the finance portfolio from Mukherjee, now that he is expected to shift from the North Block to Rashtrapati Bhavan.

"I have been churning it in my mind," the prime minister said.

"Quite honestly I have a number of issues which I have to resolve. It will not be proper for me to announce while I am outside the country. When the decision is taken, you will get to know about it."

PM assures growth, reforms, stable rupee:

Prime Minister Manmohan Singh has sought to assure investors of every step, including reforms, to restore confidence on India while also hoping for higher growth, lower inflation and correction in the depreciating rupee.

"We need foreign investment - both portfolio and direct investment," the prime minister told reporters on his way back from G20 and Rio+20 summits in Mexico and Brazil, when asked about the ratings downgrade of India.

"If there are any obstacles which come in the way, and if there are any policy impediments, we will address them effectively and credibly," the prime minister added when also asked about the perception of policy paralysis in India.

Manmohan Singh, who has been away to these two summits since Saturday last, said he owed it to the country to take all the necessary decisions that would return the economy to a high growth path.

"There are problems with regard to the fiscal management. We will tackle that problem effectively and credibly. There are problems with regard to management of the balance of payments deficit on the current account. Those problems also we will tackle."

"It will not be proper for me to talk about these things in detail," he said when asked about specific measures, but said people wanted growth momentum restored and that he will not disappoint them.

The prime minister also felt that there was no sign of any serious threat to the Indian economy even as he felt the Reserve Bank of India (RBI) was competent to act on interest rates, inflation and the value of the rupee.

"There is no stagflation. There is a slowing down. I am still confident that we can ensure that the growth rate of the economy in the rest of the year will improve to about 7 percent per annum," he said.

"As far as rupee is concerned we operate in a system that is a market based exchange rate. We intervene only to curb violent fluctuations. I am confident that measures that I outlined will return rupee also to a more stable path."

The prime minister, who looked relaxed and at ease during the 25-minute media interaction, was also candid enough to maintain there were issues that needed immediate attention, but assured action.

"A lot of things that are not going right they have their origins outside India. The 2008 financial crisis affected our growth. Our growth rate fell from 9 percent to 6.7 percent," he sasid.

"But then came the Eurozone crisis and therefore there is a flight of capital from large number of developing countries," he said, adding the money was going to Germany and the US for want of safety.

"Therefore all developing countries, including China, are experiencing a deceleration of growth rates. Having said that let me say that there have been problems in our own country. We have to work harder than ever before in restoring fiscal balance," he said.

"We have to work systematically to ensure that the balance of payment problem is managed properly and the climate for foreign investment, both direct and portfolio is also favourably motivated."

While expressing confidence on the Indian economy, he also appealed to all political parties to come forward in pushing forward measures that will restore global investor confidence.

"I am still confident when it comes to dealing with basic fundamental problems of our country, all political parties will join hands, whether it is the Trinamol Congress or other parties. I expect each one of them to play their role in moving this country back to the high growth path that we are capable of."

Prime Minister Manmohan Singh Saturday congratulated Raja Parvez Ashraf on his appointment as Pakistan's new prime minister and voiced confidence that New Delhi and Islamabad will continue to make progress in their bilateral issues and strengthen cooperation during his tenure.

"I am confident that during your term as Prime Minister, our two countries will continue to make progress in their bilateral dialogue on all issues and build good neighbourly relations by strengthening their cooperation in all areas for the benefit of the people," Manmohan Singh said in a message to the Pakistan prime minister.

"I would like to extend to you my heartiest congratulations on your appointment as Prime Minister of the Islamic Republic of Pakistan," said Manmohan Singh.

"On behalf of the people and Government of India and alsoon my own behalf, I convey to you our best wishes for success in your new assignment as well as for the peace, prosperity and well-being of the people of Pakistan under your leadership," he said.

Ashraf of the ruling Pakistan Peoples Party (PPP), a former federal minister in the government of ousted prime minister Yousuf Raza Gilani, was Friday elected the country's 25th prime minister by 211 votes to 89 by a special session of the National Assembly, the lower house of parliament.

Ashraf, a former minister for water and power, and information and technology, was administered the oath of office by President Asif Ali Zardari Friday night.

The prime minister's post became vacant after the Supreme Court disqualified Gilani with effect from April 26 after his conviction for contempt of court for refusing to write to the Swiss authorities to reopen corruption case against President Zardari.

Grb2 holds powerful molecular signaling pathway in check

Once considered merely a passive link between proteins that matter, Grb2 - pronounced "grab2" - actually lives up to its nickname with its controlling grip on an important cell signaling pathway, scientists at The University of Texas MD Anderson Cancer Center report in the June 22 issue of Cell.

"Grb2 is a switch that controls normal signaling through the fibroblast growth factor receptor (FGFR)," said the paper's senior author, John Ladbury, Ph.D., professor in MD Anderson's Department of Biochemistry and Molecular Biology.

"Perhaps the best way to think about it is that Grb2 controls cell homeostasis (stable state) before a growth factor binds to FGFR, activating this molecular pathway," Ladbury said.

In addition to discovering a fundamental aspect of FGFR signaling, the researchers' discovery points to a potential explanation of why genomic alterations found in breast, bladder and gastric cancers and melanoma might promote cancer formation and growth, Ladbury noted.

FGFR has a docking station to receive growth factors on the cell surface, and another internal region that passes the growth factor signal on to proteins inside the cell by attaching phosphate groups to them.

FGFR employs phosphorylation to regulate a number of important processes, including the cell cycle, cell proliferation and migration. When some of these pathways become overactive, they can contribute to cancer growth and survival.

Like "a car idling in neutral" ready to go

Grb2's full name reflects its location: growth factor receptor-bound protein 2. In the great rush of molecular signaling pathway mapping in the 1990s, Ladbury noted that Grb2 was labeled an "adaptor protein," one that has no activity of its own apart from connecting to other proteins.

Mapping ran way ahead of figuring out each protein's function in a signaling pathway, Ladbury said, and scientists are still catching up in that area.

"When you think about it, why would a cell bother to produce a protein that plays only a passive role linking one protein to another?" Ladbury said. He and his colleagues found that's simply not the case with Grb2.

They demonstrated that Grb2 binds to the internal signaling region of FGFR, preventing the receptor from activating other pathways while at the same time allowing a baseline level of phosphorylation of FGFR that isn't strong enough to initiate a signal by recruiting other proteins. This baseline phosphorylation occurs without a growth factor activating the receptor and only happens if Grb2 is bound to FGFR.

"You can think of this like a car that's idling in neutral," Ladbury said. "Its engine is running but it's not going anywhere. "

But it is primed for action, and the team found that this idling version of FGFR is more likely to attract an external growth factor that triggers full signaling. They also found when the growth factor FGF docks at the receptor and activates it:

  • FGFR then attaches a phosphate group to the Grb2 that was holding it in check.
  • Phosphorylated Grb2 disconnects from the receptor.
  • With its internal signaling domain now clear of Grb2, FGFR can change the shape of the domain so it can signal to other proteins by phosphorylating them.

"The growth factor essentially slots that idling car into gear, and off it goes," Ladbury said. Having FGFR warming up before activation appears to be a more efficient way for a cell to activate the pathway than starting from a state of zero phosphorylation.

There's reason to believe this mechanism may apply to other tyrosine kinase receptor proteins, a class of receptors including FGFR that activate signaling cascades by phosphorylating other proteins, Ladbury noted. Additional research will be required to sort out that possibility.

Potential role in cancer suppression

Their findings provide a possible mechanism to explain why genomic deletions found in bladder and gastric cancer and point mutations in melanoma might promote those cancers.

In each case, the portion of the gene that encodes FGFR's internal signaling domain is affected. If that domain is abnormal, Grb2 would not be able to bind it."That could lead to the FGFR pathway being turned on constantly," Ladbury said.

FGFR launches the MAPK signaling pathway, which is known to promote cancer when abnormally activated. Ladbury and colleagues have identified a potential tumor-suppressing role for Grb2.

The team developed and confirmed the relationship between Grb2 and FGFR via cell biology experiments, biophysics and structural analysis."I'm extremely proud of this group, which can cover all of those bases and provide a full explanation of a system," Ladbury noted.

The Ladbury group continues to investigate:

  • Whether cancer cells are predisposed to have abnormal levels of Grb2 , which would affect the control of FGFR signaling.
  • How disruption of the cycle of Grb2 binding and release leads to cancer.
  • The mechanism by which Grb2 is phosphorylated by FGFR.
