The Year In Dirty Energy: Keystone XL

This year, a deal between TransCanada and the U.S. government almost allowed one of the most disastrous plans in energy history to win aproval. The deal would have allowed TransCanada to build the Keystone XL pipeline across the U.S. border to carry an exceptionally dirty form of oil from Alberta's tar sands through several U.S. states to refineries along the Texas gulf?coast.

But thanks to some bizarre GOP politicking in the year-end fight over payroll tax cut legislation, the table is set for President Obama to reject this fossil folly. The likely demise of one giant ill-advised pipeline is no small feat, but it doesn't mean the world can forget about the tar sands, by a long shot. The world is still addicted to oil, and Canada's fossil-friendly leaders will continue their quest to sell the tar sands bitumen on the global?market.

Ever since our founding in 2006, DeSmogBlog has helped spread the word about the dangerous health and climate impacts that the tar sands pose to the environment and the global climate. Over the past year, we focused our research particularly on the dirty tricks employed by the oil industry in an effort to get the Keystone XL pipeline?approved.

After Friends of the Earth exposed the fact that TransCanada's Keystone XL lobbyist Paul Elliott had worked on Hillary Clinton's 2008 presidential campaign and enjoyed special access with former colleagues, DeSmogBlog revealed further?ties between TransCanada lobbyists and the U.S. government. For example:

However, the tar sands industry?s use of former Clinton associates to lobby on the controversial project extends beyond Mr. Elliott. DeSmogBlog has uncovered seven other influencers or lobbyists with ties to Clinton and Obama who have lobbied on behalf of tar sands interests for approval of the Keystone XL pipeline.

McKenna Long & Aldridge is one of the key outside firms registered to lobby for TransCanada Pipelines, which paid the McKenna firm at least $190,000 over the last 5 years to lobby on their pipeline issues, including $40,000 in the first half of 2011. McKenna employees donated $41,650 in campaign contributions to Hillary Clinton in 2008, according to the Center for Responsive Politics.

We also helped make public the financial interests that members of Congress had in the approval of the pipeline:

"Rep. Michael McCaul, R-Texas, reported in his 2010 financial disclosure form?the most recent available, filed on May 15, 2011?that he owned Transcanada stock worth between $115,002 and $300,000 (financial disclosure forms ask members to report their assets within broad ranges)."

"Sen. Thad Cochran, R-Miss., reported owning between $15,001 and $51,000 in TransCanada stock in his 2010 financial disclosure; according to his office, the ranking member of the Senate Appropriations Committee sold his stock on January 5, 2011."

"Rep. Judy Biggert, R-Ill., has held Trans Canada stock since 2004; her most recent disclsosure shows she owns a stake in the company worth between $1,001 and $15,000."

"Rep. Carolyn McCarthy, D-N.Y.?reported a $798 interest in Trans Canada."

"U.S. Ambassador to the UN, Susan E. Rice filed that she owned between $250,001 and $500,000 of TransCanada stock."

But the money didn?t end there:

TransCanada Corp, the company hoping to build the controversial Keystone XL pipeline, spent $540,000 on lobbying in the third quarter of 2011, according to lobbying disclosure records released this week.

In addition to $390,000 reported by Paul Elliott, TransCanada Pipelines, Ltd's infamous in-house lobbyist, two outside firms lobbied on TransCanada's behalf to promote the Keystone XL pipeline: Bryan Cave LLP, which reported $120,000 in earnings from TransCanda in quarter three; and McKenna, Long & Aldridge, which was paid $30,000 by TransCanada in the same period.

The industry ties became such a problem for the project that the U.S. inspector general?s office announced an investigation into the matter. And for good reason ? the State Department?s ties to TransCanada helped the company escape a more thorough review of the project:

EPA identified a laundry list of omissions in the State Department?s Supplemental Draft Environmental Impact Statement (SDEIS), ranging from lack of adequate consideration for oil spills and impacts on low income and First Nations communities, to lifecycle greenhouse gas emissions and impacts on water and wildlife. They also provided a list of critical areas that need expansion in the Final EIS.

The EPA?s analysis raises considerable concerns about the proposed project that would carry 900,000 barrels of tar sands oil per day from Canada, through Montana, South Dakota, Nebraska, Kansas, Oklahoma, and Texas, and across numerous water bodies including the Yellowstone, Missouri, Neches and Red Rivers, as well as the Ogallala aquifer.

On another front, Rep. Henry Waxman urged Congress to investigate the financial ties to Keystone of the Koch brothers:

Rep. Henry Waxman (D-CA) renewed his request to Reps. Fred Upton (R-MI) and Ed Whitfield (R-KY) that the House Committee on Energy and Commerce investigate Koch Industries' interest in the Keystone XL pipeline. Rep. Waxman's letter cites the recent revelations in InsideClimate News that Koch subsidiary Flint Hills Resources Canada LP claimed "a direct and substantial interest" in the Keystone XL in front of Canadian regulators, while the Kochtopus continues to deny any interest publicly.

Koch representatives previously told Rep. Waxman that Keystone XL has "nothing to do with any of our businesses" and that Koch has "no financial interest" in the pipeline.

And there was good reason to believe that the Kochs were among those behind the push to fast-track the pipeline?project:

What?s been left out of the fierce debate over the pipeline, according to SolveClimate News, is the prospect that if president Obama okayed the Keystone XL pipeline, he would be handing a major victory and great financial opportunity to Charles and David Koch, his staunchest political enemies and the most powerful opponents of his clean economy agenda.

SolveClimate?s analysis shows that Koch Industries is already responsible for close to 25 percent of the tar sands crude that is imported into the United States, and is well-positioned to cash in big from increased Canadian tar sands imports.

The major talking point behind the push for the pipeline was that it would create much-needed jobs for American workers. But as we and many others pointed out extensively, the job creation claims were completely bogus:

According to The Washington Post, the prospect of job creation ? the reason so many people in America support the pipeline ? isn?t as rosy as TransCanada would have us believe. In fact, their numbers don?t add up at all.

TransCanada threw out a figure of 20,000 jobs (13,000 construction, 7,000 for suppliers) that would be created directly and indirectly through the pipeline construction process. This is the figure that politicians have used to sell the pipeline to their constituents. But as The Washington Post points out, TransCanada chief executive Russ Girling admits the 20,000 figure is far from honest

And more:

In reality, according to the exhaustively researched Cornell report, even the earliest, most modest claims seem unrealistic.

In fact, in Pipe Dreams? Jobs Gained, Jobs Lost by the Construction of Keystone XL, the institute says more jobs could actually be destroyed than created by the pipeline.

As if the industry lobbyist ties and the lies about job creation weren?t enough, there is the glaring observation that the pipeline is just not safe?for water supplies and public?health:

The Natural Resources Defense Council (NRDC), the Pipeline Safety Trust, the National Wildlife Federation and the Sierra Club jointly published a new report [pdf] which details the likelihood that there will be leaks and major oil spills into waterways along the pipeline?s path.

The report explicitly states how tar sands oil is more corrosive than conventional oil and therefore is a much higher risk to pipeline systems. The report notes that it is:

?More acidic, thick, and sulfuric than conventional crude oil?contains fifteen to twenty times higher acid concentrations than conventional crudes and five to ten times as much sulfur as conventional crudes. It is up to seventy times more viscous than conventional crudes. The additional sulfur can lead to the weakening or embrittlement of pipelines.

Because of its damaging effects to pipeline systems, tar sands oil spills will be more frequent than with conventional oil and as such, more devastating to the health and livelihoods of residents, farms and communities

And who can forget the impact that thousands of?protesters rallying in front of the White House?had:

The DC police force must have recently put in a big order for plasti-cuffs. The commencement of the Keystone XL pipeline protest, which kicked off this past weekend, saw over 100 arrested in the first two days. But there won?t be time for a donut break yet, as the action is set to continue over the next two weeks with over 2,000 people signed up to get arrested in protest of the Keystone XL tar sands pipeline that would carry the world?s filthiest oil from Canada to the Gulf Coast if approved by the Obama administration.

With people coming in from all around the nation, protesters hope to pressure President Obama to deny the permit needed to build the proposed 1700-mile pipeline from Alberta to the US Gulf Coast. Reports about the supposed safety of the pipeline have proven less than stellar, and TransCanada pipelines have already had 12 spills this year. The administration must make a decision about the pipeline by November 1st, and there is pressure coming from cheerleaders of pollution such as the Chamber of Commerce and Americans for Prosperity, to name a few, for the pipeline to go through.

The Keystone XL pipeline is a perfect example of how direct action and independent media can help expose dirty politics and bring some accountability to those making important decisions about our energy future. Hopefully, more and more issues will meet the same resistance from citizens, causing government officials to rethink their disastrous plans to continue down the dirty energy?path.

Chesapeake Energy to Sell a Pipeline Unit for $865 Million

Chesapeake Energy, the second-largest producer of natural gas in North Texas' Barnett Shale, has plans of selling off one of its pipeline units, Appalachia Midstream Services, L.L.C., to Chesapeake Midstream Partners LP. Chesapeake Midstream Partners LP is the entirely owned Chesapeake Midstream Development, L.P. subsidiary of that holds its Marcellus Shale midstream assets.

Energy companies usually favor the corporate structures of Master Limited Partnerships are corporate structures. Now what happens is that these partnerships make their investors more capital efficient than any other structure by paying nearly no taxes and outdoing almost all profits along to investors.

Chesapeake Energy has been an aggressive buyer of land to drill in North America and faces a shortfall with its financial support next year and has been striking deals to close the gap.

The Acquisition

The $864 million acquisition is expected to close by 30th of this month. Chesapeake Energy will be financed by $600 million of cash drawn from Chesapeake Midstream Partners LP's rotating credit facility and equity consideration of $265 million (9.8 million Chesapeake Midstream Partners LP. common units), which would further increase Chesapeake's limited partnership ownership of Chesapeake Midstream Partners LP. from 42.3% to 46.1%. On December 20, 2011, Chesapeake Midstream Partners LP. ?completed an amendment of its credit facility for increasing the total borrowing capacity to $1.0 billion.

J. Mike Stice, Chief Executive Officer of Chesapeake Midstream said, "The partnership expects to pursue a substantial number of asset dropdowns from Chesapeake in the years ahead."

Chesapeake Energy and private investment fund Global Infrastructure Partners collectively formed the Chesapeake Midstream in order to operate gas gathering systems and other midstream energy assets.

Neither Chesapeake Energy nor Chesapeake Midstream stock was moving hours after Chesapeake Energy closed down 86 cents at $22.66 while Chesapeake Midstream closed up 29 cents at $27.12. The latest deal comes a little more than a year after Chesapeake Midstream Partners acquired Louisiana pipelines for $500 million from a Chesapeake Energy subsidiary.

Prospective Future of Chesapeake Energy

It is expected that the new expansion project will add 70 miles of new pipelines to the Texas Eastern pipeline system and raise its capacity by 18 percent. The extra capacity of 1 billion cubic feet per day will enable Chesapeake to efficiently transport the natural gas from the shale deposits in Utica to consumers in the region.

November 20114 will see the operation of new pipelines and American Electric will make use of it to fuel its power plants. The companies expect other plants to eventually begin using the pipeline too.

The cost effectiveness and environment friendliness of natural gas is posing potential demand in consumers and industrial makers. But, it is facing a tough time due to the limited availability of infrastructure.

A few days after Will Smith posted a photo on his Facebook (below) of him and fellow cast members from The Fresh Prince of Bel Air, many wondered: where was actress Janet Hubet, who portrayed the character of Smith's aunt, Vivian, for multiple seasons?

The answer, according to Hubert herself: Nowhere to be found near the former star of that sitcom... and don't expect that to change any time soon.

"I will never do anything with an a--hole like Will Smith," Hubert told TMZ. "He is still an egomaniac and has not grown up. This constant reunion thing will never ever happen in my lifetime unless there is an apology, which he doesn't know the word."

Hubert believes Smith got her fired in 1993, halfway through the show's run, because she refused to kiss up to the actor. He, of course, tells a different version, claiming Hubert was simply bitter because he instantly got a major break in the acting business, while she struggled for 10 years.

But both agree on one thing apparently: "To her I'm just the AntiChrist," Smith told an Atlanta radio station.

(AP) ? The lawyer for the California man charged with the attempted murder of an Afghanistan war veteran said his client was under attack when gunfire rang out.

Ruben Ray Jurado, 19, was charged Tuesday with attempted murder and multiple sentencing enhancements for using a firearm in the shooting that critically wounded Christopher Sullivan, 22, a Purple Heart recipient. Jurado was scheduled to be arraigned by video conference call Wednesday afternoon but that was postponed until Thursday morning when Jurado asked to attend the hearing in person.

Sullivan was home for the holidays at a homecoming party when a fight began over football, authorities said. When Sullivan moved to break it up, gunfire broke out, police said.

Defense attorney Michael J. Holmes said Tuesday that he wanted to talk to his client and the district attorney before commenting further on the case.

"It appears that he was being attacked and he was on the ground and was being kicked in the back, stomach, the head, and that is consistent with the injuries that I observed," Holmes said. "It is alleged at that point that Mr. Sullivan was shot."

Authorities said Jurado, who had played football with Sullivan in high school, began arguing with Sullivan's brother over football teams at the party Friday night and then punched him. Sullivan intervened and Jurado pulled a gun and fired multiple shots, hitting Sullivan in the neck, police said.

Sullivan remains in critical condition. His relatives said the gunfire shattered his spine and left him paralyzed from the neck down.

"He's opening his eyes more," his 20-year-old brother, Brandon Sullivan, told The Associated Press. "We're just waiting day by day."

Sullivan was wounded in a suicide bombing attack last year while serving with the military in Afghanistan. He suffered a cracked collarbone and brain damage in the attack and had been recovering in Kentucky, where he is stationed, before coming home for the holidays.

Sullivan was a wrestler and football player in high school in San Bernardino, about 60 miles east of Los Angeles. He had nine months to go in the military and then planned to become a firefighter or police officer. He always liked to help people, his brother said.

"Say there was a person at school who never had friends or nothing ? Chris would be the person who would go up to him and try to be his friend. He didn't like people to feel alone," Brandon Sullivan said. "He always had a smile on his face."

Heavy artillery should be removed from the Line of Control (LoC) in Jammu and Kashmir, Pakistan has suggested to India during the two-day talks being held in Islamabad on conventional and nuclear confidence building measures (CBMs), a media report said Tuesday.

After a gap of four years, Pakistan and India Monday held talks on conventional CBMs, while discussions on nuclear CBMs were held Tuesday.

The talks are the first formal engagement since Pakistani Prime Minister Yousuf Raza Gilani met his Indian counterpart Manmohan Singh in the Maldives at the SAARC summit meeting early in November.

The Wall Street Journal reported that Pakistan made the proposal on removing heavy artillery Monday.

Islamabad suggested that artillery of greater than 120 mm be moved 30 km from the LoC. The LoC divides Jammu and Kashmir between India and Pakistan.

The expert-level meeting on nuclear and conventional CBMs is being held after a gap of four years.

Y.K. Sinha, joint secretary in charge of Pakistan desk in India's external affairs ministry, is leading the Indian side at the talks on conventional CBMs. The talks on nuclear CBMs were led by Venkatesh Verma, joint secretary in charge of disarmament in India's external affairs ministry.

Munawar Saeed Bhatti, additional secretary in Pakistan's ministry of foreign affairs, heads the Pakistan delegation for both expert groups.

Pakistan and India resumed in February early this year their dialogue process that was stalled after the Nov 26, 2008 Mumbai terror attack perpetrated by Pakistani terrorists.

Beijing 2008 Gold medallist Tom Ashley has revealing that he will not be challenging Yachting New Zealand's decision to send Jon-Paul Tobin to the London 2012 Olympic Games instead of him. Tobin's announcement as the New Zealand representative caused controversy over the selection criteria, and now Ashley is considering whether to retire or bid to make it to Rio de Janeiro in 2016.

''I've got no interest in trying to fight it,'' Ashley said.

''I don't think it would be good for anyone.

"I respect their decision and I respect the people involved, it just wouldn't be fair.''

With heavy weighting placed on their performance at the World Championships in Perth as well as the pre-Olympic regatta in Weymouth earlier this year, Ashley suspects this was why he did not make it to London.

Tobin, 24, finished ahead of Ashley in Perth, and the 27-year-old said that it was not "100 per cent unexpected" that he would miss out after his performance, though he could also count himself unlucky as he has suffered with injury this year.

''You never know exactly what the selectors are thinking,'' he added.

''In the end it's not 100 per cent dependable on results but obviously you want to beat the other guy, and I didn't.'

''They obviously thought long and hard about it and they wouldn't take a decision lightly.

"They've sent the person they think is best and that's good enough.''

Ashley hinted that he could leave sailing now, saying that "we'll see," but added that he would take time to think it over.

WINTER SPORTS TRIBUTE: Lightning boys basketball

BROOMFIELD, Colo. -

The keyword for the Lightning this year was transition.

First-year head coach Darren Clemenhagen was leading a squad with a new look that was adjusting to the loss of its standout, Trevor Noonan, who graduated and moved on to the Air Force Falcons.

"Trevor left a pretty big hole," Clemenhagen said. "He did a lot for this team, so now we need to get players stepping up to fill that hole."

Players being able to make the transition and step up was Clemenhagen's key to the season's success. He planned to rely heavily on the offensive production and leadership of senior Nick Noffsinger. Last season, he was Legacy's second leading scorer behind Noonan

The outside shooting of Jade Roberts also was expected to bolster the Lightning offense. The junior started the last five games of last season and was deadly accurate beyond the arc.

The Lightning this year also finally got to see transfer senior Walter Cooper in action. After transferring from Denver East, Cooper was forced to sit out most of last season because of Colorado High School Activities Association regulations.

The Lightning stayed on a roll for much of the season, making a Cinderella run for the Front Range League title. The fairy tale ended, however, on Feb. 17 when Legacy fell 73-48 to undefeated and top-ranked Fairview. Prior to that game, Legacy had won 14 of its past 15 games.

Legacy fell behind early, but made a valiant effort at making a run at Fairview.

The team got as close as nine points in its 18-point second period, turning to its inside game out of necessity. Roberts was particularly potent, rattling off six of his 11 points in the period fighting through a crowded lane.

Roberts and Cooper (10 points) each broke into double digits.

"In the first half, we showed some glimpse of being able to attack (Fairview)," coach Clemenhagen said. "But by the third quarter our kids were so mentally fatigued that you could see it."

Losing out on the title didn't mean Legacy would miss out on the postseason. The Lightning beat Horizon 57-52 in their first-round game, before falling 42-55 to Heritage in the second round.

It's that time for caroling, eggnog, holiday cheer ? and for some, a frantic dash to the mall.

Last-minute shoppers hit stores on Christmas Eve in a surge that retailers hope will top off a strong holiday shopping season.

Among them was Len Boswell. He started his shopping at 6 a.m. at Starbucks. Later in the morning he was at a CVS drugstore in Decatur, Ga., picking up candy and a neck pillow for his wife.

"I should have done this a couple of weeks ago," acknowledges Boswell, 68, a director of book publishing at a nonprofit.

Stores are expected to ring up $469.1 billion during the holiday season, which runs November through December. The final week before Christmas can account for up to 20 percent of those sales. Retailers tempered their expectations heading into the season because they worried that Americans weren't ready to spend in the weak economy.

But sales have been brisk during the two-month period, rising 2.5 percent from the start of the season on Nov. 1 through last Saturday, according to research firm ShopperTrak, which did not give a dollar figure. As a result, ShopperTrak upgraded its sales growth forecast to 3.7 percent from its 3 percent estimate heading into the season.

"We're seeing good traffic, good sales," said Sherif Mityas, a partner in the retail practice at A.T. Kearney, a management consulting firm. "Even with all the bad news and hesitancy in terms of the economy, consumers are still opening up their wallets more than last year, which is good news."

But at a time when Americans are still concerned about high unemployment, stagnant wages and market uncertainty, retailers aren't willing to leave anything to chance on the final shopping days before Christmas.

Toys R Us and some Macy's have been open 24 hours a day in the days leading up to Christmas. At malls, Abercrombie & Fitch has been offering a blanket 50 percent off on all items while J. Crew and Madewell offered 30 percent off. Retailers' promotional e-mails are up 34 percent from a year ago, according to Responsys, which tracks e-mail activity from more than 100 merchants.

"They're clearly putting their best foot forward on promotions right now," said John Morris, analyst at BMO Capital Markets. Morris estimates that promotional sale activity is up about 7 percent compared with last year, taking into account the level of markdowns and the amount of goods marked down.

Whether it's the sales or just plain-old procrastination, last-minute shoppers were drawn to stores across the country on Christmas Eve.

Taubman Centers, which operates malls across the country including The Mall at Short Hills in New Jersey and Beverly Center in Los Angeles, reported almost-full parking lots at some malls by 10 a.m., earlier than last year. Apparel, electronics, perfume and jewelry were among the biggest sellers.

Macy's, in New York's Herald Square, also was packed with shoppers by late morning. The store has been open around the clock since Wednesday and was set to close at 6 p.m. on Saturday.

Kimberly Sylvester, 28, was out for the first time doing her holiday shopping Christmas Eve. She had already spent $160 at Victoria's Secret, taking advantage of a sale ? two bras for $40 ? for her sister. At Macy's, she picked up Lauren by Ralph Lauren sheets marked down to $79. Sylvester, who works with special needs children, said she has been too busy to shop.

At Manhattan Mall in New York, there was a steady stream of shoppers Saturday morning.

Shamek Shider, 22, was among them. He had spent $100 at Macy's on snow suits for his goddaughter on Friday, his first time out holiday shopping. He came back on Christmas Eve and spent $250 on jewelry and clothing at Macy's and J. C. Penney for his mother, sister and other relatives.

"This is when I see the best deals," said Shider, who lives in Newark, N.J.

Ryan Eagle, 25, planned to hit South Park Mall in Charlotte, N.C., Saturday morning to shop for presents for his wife. He always shops on Christmas Eve, he said, to get good deals and to people-watch. Last year, he found $200 boots on sale for $50 at Macy's.

"I'm a last-minute person," he said. "I enjoy going out and watching everyone run around."

Tax cut survives: Congress votes holiday approval (AP)

WASHINGTON ? Barely beating Santa's sleigh, Congress delivered a last-minute holiday tax-cut extension to 160 million American wage-earners on Friday, just when it looked like they and millions of unemployed workers were going to be left with coal in their stockings.

It was a major yearend political victory for President Barack Obama, a big slice of humble pie for House Republicans and a blow to House Speaker John Boehner, R-Ohio, who'll have an angry band of tea party lawmakers to deal with when Congress returns to Washington next month.

Back-to-back voice vote approvals of the two-month special measure by the Senate and House came in mere seconds with no debate, just days after House Republican leaders had insisted that reopening negotiations on a full-year bill was the only way to persuade them to prevent a tax increase on Jan. 1.

Obama immediately signed the bill into law.

"I said it was critical for Congress not to go home without preventing a tax increase on 160 million working Americans and I'm pleased to say that they got it done," a buoyant looking Obama said at the White House before dashing off for his delayed holiday vacation to his home state of Hawaii.

Actually most lawmakers were long gone. A token few showed up to make approval official.

The legislation buys time for talks early next year on how to finance the year-long extensions ? negotiations that promise to be contentious, especially if Democrats continue to use Obama's jobs agenda to seek a political edge in the 2012 presidential and congressional campaigns.

The measure will keep in place a 2 percentage point cut in the Social Security payroll tax ? worth about $20 a week for a typical worker making $50,000 a year ? and prevent almost 2 million unemployed people from losing jobless benefits averaging $300 a week. Doctors will win a reprieve from a 27 percent cut in their Medicare payments, the product of a 1997 cut that Congress has been unable to permanently fix.

Republicans did claim a major victory, winning a provision that would require Obama to make a swift decision on whether to approve construction of the Canada-to-Texas Keystone XL oil pipeline, which could generate thousands of construction jobs. To stop construction, Obama, who had wanted to put the decision off until after the 2012 election, would have to declare it was not in the nation's interest.

On Friday, an expressionless Boehner read from a piece of paper before him, gaveled the House's last session of the year closed and stepped off the podium on the Democratic side.

Boehner had been open to the Senate's version of the legislation a week ago, even though it would have punted the issue into February and given Democrats a proven political issue. But tea party forces and some in his own leadership revolted, insisting on picking a holiday fight with Democrats, and Boehner felt no choice but to go along.

The battle turned out to be a loser for House Republicans, earning the ire of swing voters and many in the GOP establishment, but when Boehner capitulated on Thursday he then felt the lash from hard-core conservatives.

"Even though there is plenty of evidence this is a bad deal for America ... the House has caved yet again to the president and Senate Democrats," said Rep. Tim Huelskamp, R-Kan.

Meanwhile, Democratic Senate leader Harry Reid of Nevada did a victory lap, twisting the knife into tea party Republicans.

"I hope this Congress has had a very good learning experience, especially those who are newer to this body," Reid said. "Everything we do around here does not have to wind up in a fight."

A full-year extension of the tax cut had been embraced by virtually every lawmaker in both the House and Senate but had been derailed in a quarrel over demands by House Republicans. Senate leaders of both parties had tried to barter their own yearlong agreement a week ago but failed, instead agreeing upon a 60-day measure to buy time for talks next year.

House GOP arguments about the legislative process and what the "uncertainty" of a two-month extension would mean for businesses seemed lame to many people when compared to the consequences of raising taxes and cutting off jobless benefits in the middle of the holiday season, and Obama and the Democrats were hard on the offensive. House Republicans finally resorted to a technical fix and the fact that Reid would name negotiators on the GOP's yearlong measure as reasons to reverse course and embrace the Senate measure.

Friday's House and Senate sessions were remarkable. Both chambers had essentially recessed for the year, but leaders in both parties orchestrated passage of the short-term agreement under debate rules that would allow any individual member of Congress to derail the pact, at least for a time. None did.

The developments were a clear win for Obama. The payroll tax cut was the centerpiece of his three-month, campaign-style drive for jobs legislation that seems to have contributed to an uptick in his poll numbers ? and taken a toll on those of congressional Republicans.

The two-month version's $33 billion cost will be covered by a 0.1 percentage point increase on guarantee fees on new home loans backed by mortgage giants Fannie Mae, Freddie Mac and Ginnie Mae ? at a likely cost of about $17 a month for a homeowner with a $200,000 mortgage.

The top Senate Republican, Mitch McConnell of Kentucky, was a driving force behind the final agreement, imploring Boehner to accept the deal that McConnell and Reid had struck last week and passed with overwhelming support in both parties.

Even though GOP leaders including House Majority Leader Eric Cantor, R-Va., promised that the two sides could quickly iron out their differences, the truth is that it will take intense talks to figure out both the spending cuts and fee increases required to finance the longer measure.

Republicans want to shorten the maximum length of unemployment benefits from 99 to 79 weeks, freeze the pay of federal civilian workers and make federal workers contribute more into their pensions ? all ideas considered by the failed debt "supercommittee" this fall. The main provisions of the yearlong House measure cost about $200 billion, and the final version could cost more.

Reid signaled a hard line for the House-Senate talks by assigning Sen. Ben Cardin, D-Md. ? a strong advocate for federal workers ? to the Democratic negotiating team.

Leona Lewis Runs to The X Factor Finale Stage


Leona Lewis now has something in common with Melanie Amaro: each was named the first-ever female winner of a version of The X Factor; Lewis in Great Britain and Amaro, of course, in the United States.

So it was only appropriate that Leona was present during last night's first season finale of this Fox competition, singing a beautiful version of her hit single, "Run." Watch and listen now:

Lewis wasn't the only superstar to take the stage prior to Amaro being crowned champion. Justin Bieber actually performed a pair of holiday tracks, teaming with one legendary artist and another young, up-and-comer.

Obama presses Boehner to compromise on tax deal (Reuters)

WASHINGTON (Reuters) ? In a bid to end a worsening standoff over extending a tax break for Americans, President Barack Obama urged Republican House of Representatives Speaker John Boehner on Wednesday to pass a short-term extension and return to talks on a year-long deal in the New Year.

While Boehner showed no immediate signs of backing down on his demand that Congress tackle the long-term deal to extend a payroll tax cut before it expires at year's end, calls for compromise in his own party grew. With 2012 elections looming, some Republicans fear they will be blamed for letting the tax bill rise on January 1 for 160 million Americans.

Obama telephoned Boehner and Senate Majority Leader Harry Reid, a Democrat, to stress his willingness to work with Congress to get an agreement on the expiring payroll tax cut for 160 million Americans, White House spokesman Jay Carney said.

Obama asked Boehner and House Republicans to drop their opposition to a short-term measure that the Senate passed overwhelmingly at the weekend and signaled an unwillingness to reopen negotiations now, as Republicans are demanding.

Obama and many economists say the payroll tax cut is crucial to the country's fragile economic recovery.

"The president reiterated the need and his commitment to work with Congress to extend the payroll tax cuts for the entire year," Carney said, adding that the two-month extension negotiated by the Senate was "the only option to ensure that middle class families are not hit with a tax hike in 10 days."

While Obama is not reopening talks, his gesture on Wednesday might be seen as a nod to Republican demands. It came just hours after Republican House Majority Leader Eric Cantor called for the president to get directly involved to resolve the dispute.

Meanwhile, House Republicans have been coming under heavy fire from fellow Senate Republicans and conservatives over their refusal to consider the two-month deal eked out by the Senate leadership on Friday night. Senate negotiators had been unable to agree on how to pay for a longer-term extension.

'WHEN PAYCHECKS GET SMALLER'

"The smartest thing for (House Republicans) to do would be to pass this (bipartisan Senate bill), live to fight another day and then push for a full-year extension," a senior Senate Republican aide said.

"If and when paychecks get smaller, people are going to ask, 'Why?'" the aide said. "We (Republicans) get the blame, Washington gets the blame and it won't be great for Senate Democrats either," the aide said.

The standoff caps a tumultuous year in U.S. politics that has raised serious concerns among both voters and investors about Washington's ability to make sound economic policy and slow the growth of its trillion dollar-plus deficit.

In the final days of the payroll tax cut debate, Republicans

are in unfamiliar territory after a year of largely winning the battle on taxes and budgets. They are now struggling to live up to their reputation as the party of lower taxes, while hardball tactics that had served them well before might now backfire.

Boehner's control over his caucus, which includes many Tea Party movement-aligned fiscal conservatives, has also come under increased scrutiny after House members revolted against the Senate deal.

Senate Democrats, sensing they have a political advantage on an issue that has sharply divided Republicans in the Senate and the House, are refusing to reopen negotiations. Most have already left Washington for the holidays.

The showdown has the potential to deliver a political lift to Obama and his Democrats at the expense of Republicans who want to make 2012 a referendum on Obama's handling of the economy.

"Obama doesn't have to offer that much right now," said Julian Zelizer, a political historian at Princeton University. The Republicans are the ones that have come out looking bad. Obama isn't putting much on the table beyond saying think twice about this and let's reach an agreement."

Obama seemed to agree. After the calls to Boehner and Reid, he went Christmas shopping with dog Bo while his wife and daughters waited for him to join them in Hawaii.

EMPTY CHAIRS

The day started off with mounting pressure on Boehner and House Republicans to end the standoff, from Reid to fellow Republicans to the opinion page of the Wall Street Journal.

As the war of messages escalated, Boehner called reporters, photographers and TV crews to a room on Capitol Hill where he sat at a high-glossed wooden table flanked by Cantor and eight House Republican negotiators.

"We are here ready to do our work," Boehner said. Across the table were the empty chairs reserved for the Democratic negotiators.

An editorial in the Wall Street Journal, which has often disagreed vehemently with Obama's economic policies, gave Republicans a scathing critique of their handling of the payroll tax cut issue, saying they "achieved the small miracle of letting Mr. Obama position himself as an election-year tax cutter."

The editorial urged Republicans "to cut their losses and find a way to extend the payroll holiday quickly."

The Wall Street Journal editorial page often gives insight into the thinking of leading conservatives in U.S. business and politics. Wednesday's editorial, headlined "The GOP's Payroll Tax Fiasco" suggests widespread anxiety among conservatives over the House Republican tactics.

A number of Republican senators have also blasted their House colleagues over their handling of the issue.

Republican Senator Scott Brown said: "House Republicans would rather continue playing politics than find solutions" and added that their actions would damage a fragile economy.

If the Congress cannot reach a deal by December 31, the payroll tax American workers pay to fund the Social Security federal retirement program will rise immediately to 6.2 percent, from 4.2 percent.

Many economists and the White House warn that U.S. economic growth will suffer in 2012 as most workers would be hit with an effective $1,000-a-year tax hike.

(AP)? TOKYO ? Japan's Emperor Akihito praised the compassion of a nation striving to overcome the earthquake and tsunami disasters, as he waved from his palace balcony to throngs of well-wishers for his 78th birthday Friday.

Akihito expressed gratitude to all who have worked in the aftermath of the March 11 earthquake and tsunami, which devastated northeastern Japan and left 20,000 people dead or missing. Those he thanked included military personnel, residents of northeastern Japan, volunteers, workers at a hobbled nuclear plant and overseas contributors to relief efforts.

"Looking back on this year, I must say this has been a truly distressing year, dominated by disasters," he said in a statement from the Imperial Household Agency.

"I feel that the Japanese people have come together as a nation to squarely face the disaster," said Akihito, smiling next to his wife, Empress Michiko, who was dressed in a pale beige dress.

He was accompanied by his two sons and their wives.

Akihito, the son of Hirohito ? who announced Japan's surrender after World War II ? said Japanese people have learned their lesson from history and have vowed never to go to war again. He urged everyone not to forget that lesson of peace, despite the passage of time.

Akihito was hospitalized last month for a fever and an infection, but appeared to be in good health. He said he felt better and thanked people for worrying about his health.

Akihito has three eligible male successors ? his two sons and a grandson.

Japan's emperor, revered as divine during the wartime years, now has a largely ceremonial function as a "symbol of the nation."

Holiday flying to fall slightly, trade group says

(AP) ? Fewer people will fly this holiday season, but flights will still be packed.

That's according to a forecast released Tuesday by the main trade group representing U.S. airlines. Airlines for America predicts that about 43.3 million travelers will fly on U.S. carriers over the three-week holiday period, a 1 percent decline from a year earlier. That works out to about 20,000 fewer people per day. The trade group attributes the decline to "lingering economic concerns" and high energy prices that are limiting would-be travelers' disposable income.

About 1.6 million to 2.3 million people are forecast to fly each day between Wednesday and the first week of January.

Even with fewer passengers, fliers won't have more room to stretch out. Flights will be full because airlines have reduced the number of flights and planes, the trade group said.

Packed planes don't just mean less leg room, though. Fuller planes also mean more delays if something goes wrong. Last year, when major snowstorms shut airports and crippled airlines, millions of travelers waited days to find other travel options.

A4A didn't offer a specific forecast for what passengers are paying to fly. But its chief economist, John Heimlich, expects fares in December will be on par with the rest of 2011, or about 10 percent higher than a year ago.

Even with higher fares, A4A notes that airlines are holding on to less than a penny in profit for every dollar in revenue. That's because operating expenses, mostly due to higher fuel prices, are climbing just as fast as sales.

Travelers bracing for packed planes and long lines should keep these tips in mind to make travel run smoothly:

AT HOME

? Check in a full 24 hours ahead of your flight. This will help in getting the seat you want and possibly give you a leg up later on. Some airlines board fliers according to check-in times.

? Don't forget your bags. When you check in online, make sure you indicate if you have a checked bag. Checking in luggage online will save time at the airport.

? Arm yourself with information. Look up the airline's customer service number and its contract of carriage ? the list of rights you have on a flight ? on the airline's website before you leave home. It'll pay off if something goes wrong.

? Brings snacks and an empty water bottle. You can fill the water bottle after you go through security.

? Don't wrap gifts. The TSA will unwrap anything they deem suspicious. Don't risk it.

? Pack sensibly. The holidays might not be the best time to stuff a carry-on to avoid a checked bag fee. Overhead bins will be extremely full.

AT THE AIRPORT

? Arrive early. It's the easiest way to de-stress your trip.

? Plot your attack. There are smartphone applications that let you check everything from the emptiest parking lots to security wait times. You can also sign up for flight alerts though the airlines or online travel sites that will let you know if you know if your flight is delayed or canceled.

? Wear slip-on shoes. They're the easiest to get on and off at security. This year, though, kids under 12 won't have to remove their shoes.

? Think like a seasoned traveler. Have your liquids in a plastic bag outside of your suitcase before approaching security. Take off your belt, and remove everything from your pockets (new body scanners are more sensitive to those items than metal detectors.) Also, have your boarding pass and identification in your hand to speed things up.

British government backs plan to restructure banks (AP)

LONDON ? The British government will restructure the country's banks by separating their retail activities from riskier investment banking operations, Business Secretary Vince Cable said Sunday.

Cable said the government will comply with the recommendations of an independent commission set up after the 2008 banking crisis and "proceed with the separation of the banks."

"It's absolutely right that we make the British economy safe," Cable told the BBC. "We just cannot risk having a repetition of that financial catastrophe that we had three years ago."

Treasury chief George Osborne is due to lay out the government's plans in Parliament on Monday. Cable told the BBC that the necessary legislation would be passed before the government's term ends in 2015.

The British government bought up large chunks of the country's banking system after it ran into major financial difficulties during the 2008 credit crunch. The British taxpayer now fully owns mortgage lenders Northern Rock and Bradford & Bingley, along with 83 percent of Royal Bank of Scotland and 41 percent of Lloyd's Banking Group.

Northern Rock, however, is due to be sold to Richard Branson's Virgin Money.

The Independent Commission on Banking recommended in September that the banks be restructured by 2019 to reduce the risks of taxpayers having to bear the cost of any future bailouts.

The commission, chaired by former Bank of England chief economist John Vickers, said retail banks should be "legally, economically and operationally separate" from the parent companies.

It also recommended that retail banks should be required to boost the amount of equity capital they hold.

The commission estimated its proposals would cost the banks up to 7 billion pounds ($11 billion) a year, and critics of the plan say it could slow lending at a time when the economy is in danger of sliding back into recession.

Agreement near on $1 trillion spending bill (AP)

WASHINGTON ? Bipartisan agreement is near on a massive $1 trillion-plus year-end spending package and should be reached in time avert a possible government shutdown this weekend, Senate leaders said Thursday.

The optimism came hours after Republicans said they planned to push the legislation through the House with only GOP votes. Overnight, they unveiled details of the bill, which curbs agency budgets but drops many policy provisions sought by GOP conservatives.

Democrats had been holding up the huge bill, seeking leverage in talks on extending payroll tax cuts and unemployment insurance, two pillars of Obama's jobs agenda.

But Thursday morning, Senate Majority Leader Harry Reid, D-Nev., said he had talked to top Senate Democrats who helped write the spending bill and that remaining issues "should be resolvable." He and Senate Minority Leader Mitch McConnell, R-Ky., expressed optimism that disputes over that bill and a separate measure extending a payroll tax cut were near an end.

The spending bill contains language to roll back President Barack Obama's loosening of restrictions on the rights of Cuban immigrants to send money to relatives in Cuba or travel to the island to visit them. Earlier this year, the White House promised a veto over the restrictions on travel and gifts, which are supported by many in the GOP-leaning Cuban-American community, a powerful political force in the swing state of Florida.

Release of the legislation came just a couple of hours after the White House issued a statement saying that Obama "continues to have significant concerns about a number of provisions" in the legislation.

White House Communications Director Dan Pfeiffer called for another stopgap funding bill to buy time for talks on both the spending bill and the payroll tax measure. Funding runs out Friday at midnight.

The underlying bill has bipartisan backing but could encounter turbulence with conservative tea party lawmakers seeking far more significant cuts to government agencies. The measure pays for day-to-day operating budgets of 10 Cabinet departments and programs ranging from border security to flood control to combating AIDS and famine in Africa.

Changes are still possible in the bill before a vote.

On spending, the measure implements this summer's hard-fought budget pact between President Barack Obama and Republican leaders. That deal essentially freezes agency budgets, on average, at levels that were approved back in April for the recently completed budget year.

The bill chips away at the Pentagon budget, foreign aid and environmental spending but boosts funding for veterans programs. The Securities and Exchange Commission, responsible for enforcing new regulations under last year's financial overhaul, won a 10 percent budget increase, even as the tax-collecting IRS absorbs a more than 3 percent cut to its budget.

Popular education initiatives for special-needs children and disadvantaged schools were basically frozen and Obama's cherished "Race to the Top" initiative, which provides grants to better-performing schools, would absorb a more than 20 percent cut.

Environmentalists scored clear wins in stopping virtually every significant GOP initiative to roll back Environmental Protection Agency rules. Most importantly, industry forces seeking to block new greenhouse gas and clean air rules, as well as a new clean water regulation opposed by mountaintop removal mining interests, were denied. But Republicans succeeded in blocking new energy efficiency standards for light bulbs and won delays to a new Labor Department rule requiring a reduction of coal dust responsible for black lung disease.

Drafted behind closed doors, the proposed bill would provide $115 billion for overseas security operations in Afghanistan and Iraq but give the Pentagon just a 1 percent boost in annual spending not directly related to the wars. The Environmental Protection Agency's budget would be cut by 3.5 percent. Foreign aid spending would drop and House lawmakers would absorb a 6 percent cut to their office budgets.

The measure generally consists of relatively small adjustments to thousands of individual programs. Agencies like the Border Patrol and Immigration and Customs Enforcement will get a boost within the Homeland Security Department, while GOP defense hawks won additional funding to modernize the U.S. nuclear weapons arsenal. The troubled, over-budget, next-generation F-35 fighter plane program would be largely protected.

Social conservatives won a ban on government-funded abortions in Washington, D.C., and restored a longstanding ban on funding for needle exchange programs used to prevent the spread of HIV. But efforts to take away federal funding for Planned Parenthood failed, as expected.
